1. Scope of application
The following terms and conditions apply to bookings made with Dominican Soul Tours.
2. Binding booking
The booking is confirmed when Dominican Soul Tours confirms it to the customer. Confirmation is provided in writing, by email, via messenger services (e.g., WhatsApp), or social media (e.g., Instagram, Facebook).
3. Services
Dominican Soul Tours is obligated to provide the agreed services in a proper manner. Further details regarding the booked services can be found in the booking confirmation.
4. Changes to services
Dominican Soul Tours reserves the right to make changes to services if necessary. In particular, in cases of force majeure (weather, illness, breakdown), the agreed service may be adjusted at short notice. The customer will be informed of any changes in a timely manner. If the minimum number of participants for an excursion is not reached, the customer will be informed of possible alternatives the day before.
As experience has shown that last-minute cancellations are to be expected, the specified maximum number of participants for excursions may be exceeded by 20% in exceptional cases. It should be emphasized that this is not the rule, but an exception, and only occurs when there is a high volume of reservations.
5. Prices and payment terms
The prices and payment dates for the booked services are specified in the booking confirmation. Payment must be made within the agreed period. In the event of late payment, Dominican Soul Tours is entitled to charge reminder fees and interest on arrears.
We accept Dominican pesos, US dollars, and euros as payment; other currencies are accepted by arrangement.
6. Cancellation policy
Private customers can cancel up to 24 hours before the excursion. In this case, 90% of the excursion price will be refunded. We charge a processing fee of 10% of the excursion price.
If you cancel within 24 hours of the excursion, the full price is due.
7. Illness
In the event of sudden illness occurring after 12:00 noon on the day before or on the day of the service, the amount already paid will be refunded upon presentation of a medical certificate within 24 hours. This applies only to the sick person and not to their companions or relatives. The cancellation conditions apply here.
8. Liability
Dominican Soul Tours is liable in accordance with its insurance conditions for excursions for direct damage in the event of bodily injury or death caused by the organizer. The customer bears the usual accident risk.
When asserting claims for damages against Dominican Soul Tours, the customer is obliged to assign their own claims for damages against third parties to Dominican Soul Tours.
The customer confirms that they will not carry any valuables with a total value of more than US$200 (the sum is calculated from cash and movable items such as photographic equipment, mobile phones, jewelry, etc.) on excursions.
When children participate in excursions, the adult companions (parents or authorized guardians) are liable. For boat trips, children must be provided with suitable DIN-approved life jackets.
9. Disclaimer
Claims for damages are excluded in all cases if the damage is attributable to a failure on the part of the customer or unavoidable third parties who are not involved in the provision of the booked service.
Claims for damages are also excluded if the damage is due to force majeure or if damage could not have been foreseen despite the due care taken by Dominican Soul Tours or a service provider commissioned by Dominican Soul Tours.
It is the customer’s responsibility to indicate any health impairments when making the reservation. This applies, among other things, to: pregnancy, persons with cardiovascular diseases and pacemakers, persons with acute back problems.
Dominican Soul Tours accepts no liability for souvenirs, photo and video recordings, or other services, such as massages, offered for sale by other persons or service providers during the excursions.
Dominican Soul Tours is not a contractual partner for third-party, brokered services and cannot guarantee the proper fulfillment of the contractual obligations of the brokered service providers. However, Dominican Soul Tours guarantees that the respective companies have been carefully selected.
10. Defects
If the customer considers the trip to be defective, they should contact the organizer immediately. The notification of defects must also be sent in writing by email to info@dominicansoultours.com. Claims for reduction/damages will then be examined. Notifications of defects received after a period of 7 days after the end of the service will not be considered.
11. Data protection
Dominican Soul Tours processes the customer’s personal data only for the purpose of fulfilling the agreed service and in compliance with the applicable data protection regulations.
The customer’s data will be used exclusively for the reservation and will not be passed on to third parties. Cookies are used to ensure that the website functions optimally. The detailed data protection regulations (GDPR-compliant) can be found at the bottom of the page.
